29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) George J. Gruber Construction, Inc. at 1117 18th St, Greeley, CO 80631: On and before May 4, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person, in that a subcontractor was injured when the ladder he was working on slipped causing him to fall to the ground. The base of the extension ladder was placed on top of a sheet of plywood. The base of the ladder was not secured to the plywood, nor was the plywood secured to the ground. This condition exposed the subcontractor to a fall of approximately 14 feet to the ground below. (b) George J. Gruber Construction, Inc. at 1117 18th St, Greeley, CO 80631: On and before May 4, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person, in that several holes on the east side of the building were covered with unmarked 1/2 inch sheets of plywood. The openings of the holes were approximately 2 to 3 feet and ranged from 2 feet to 4 feet in depth. This condition exposed subcontractor employees to the hazards of falling into the unmarked hole.
