29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Mountain Log Homes of Colorado, Inc. @ 578 Wooden Canoe, Frisco, CO 80443: On and before April 5th, 2011, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees and subcontractor employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approximately feet and 10 and 15 feet.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet (1.8m) or more above lower levels were not protected by guardrail systems, safety net system, personal fall arrest system, or other approved alternative fall protection system: (a) Mountain Log Homes of Colorado, Inc. @ 578 Wooden Canoe, Frisco, CO 80443: On and before April 5th, 2011 the employer did not ensure employees were protected from injury, in that, employees and subcontractor employees were exposed to fall hazards. The controlling contractor did not ensure carpenters working on a deck approximately 10 feet in height were protected from falls and subcontractor roofing employees that were exposed to 15 foot fall hazards were protected from falling.
