29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)  Mountain Builders General Contracting Corporation at 310 S. 8th Ave, Frisco, CO 80443:  On and before May 5, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The scaffold on the east side of the building lacked midrails and endrails on both the 4th and 5th levels of the scaffold. Subcontractor employees worked on the 4th and 5th levels of the scaffold at this location. This condition exposed subcontractor employees to falls of approximately 33 feet.    (b)  Mountain Builders General Contracting Corporation at 310 S. 8th Ave, Frisco, CO 80443:  On and before May 5, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The scaffold on the east side of the building lacked endrails on both the 4th and 5th levels of the scaffold. A subcontractor employee was standing at the end of the 4th level scaffold platform handing up a scaffold component to another subcontractor employee standing at the end on the 5th level. This condition exposed subcontractor employees to falls of approximately 33 feet.    (c)  Mountain Builders General Contracting Corporation at 310 S. 8th Ave, Frisco, CO 80443:  On and before May 5, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The scaffold on the north side of the building lacked midrails and endrails on the 4th level of the scaffold. Subcontractor employees worked on the 4th level of the scaffold at this location. This condition exposed subcontractor employees to falls of approximately 26 feet.    (d) Mountain Builders General Contracting Corporation at 310 S. 8th Ave, Frisco, CO 80443:  On and before May 5, 2011, the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. The scaffold on the west side of the building lacked a midrail on the 4th level of the scaffold where subcontractor employees accessed from inside the building. This condition exposed subcontractor employees to falls of approximately 26 feet.
