OSH ACT of 1970 Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that, employees were exposed to fall hazards: a) On or about May 5, 2011, employees were exposed to fall hazards in excess of 6 feet when they climbed over the rails of a scissor lift and onto an adjacent roof without fall protection. Abatement Note: Abatement certification is required for this item. See enclosed Sample Abatement Certification Letter.

29 CFR 1926.501(b)(1): Each employee on a walking/working surface with an unprotected side or edge which was 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems: a) On or about May 5, 2011, employees were not protected from falls in excess of 6 feet from a roof. Employees used a scissor lift to access the roof and were exposed to falls at the access area and where they walked across the roof to the work area. Abatement Note: Abatement certification is required for this item. See enclosed Sample Abatement Certification Letter .
