29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a)  Rockridge Building Company @ 5245 Galena St., Frisco, CO 80443:  On and before April 5th, 2011, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of between approximately 11 feet and 38 feet.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided.    (a) Rockridge Building Company @ 5245 Galena St., Frisco, CO 80443: On and before April 5th, 2011, the employer did not ensure that fall protection systems were utilized by employees engaged in roofing activities while working at the unprotected edges of a roof on a mixed-use multi-family residence. Employees were not utilizing a fall protective system while conducting roofing activities. The condition exposed employees to fall hazards of approximately 11 feet to 38 feet.

29 CFR 1926.503(a)(1):  The employer did not provide a training program for each employee who might be exposed to fall hazards:    (a)  Rockridge Building Company @ 5246 Galena St., Frisco, CO 80443: On and before April 5th, 2011, the employer did not ensure that each employee engaged in roofing operations were trained to recognize the hazards of working at elevation and trained in the use of fall protection. Employees engaged in roofing activities worked near the edge of a three story, mixed-use complex without the use of a fall protection system. This condition exposed employees to fall hazards between approximately 11 feet and 38 feet.    Abatement Note: The employer shall assure that each employee has been trained, as necessary, by a competent person qualified in the following areas:    (a)  The nature of fall hazards in the work area;    (b)  The correct procedures for erecting, maintaining, disassembling, and inspecting the fall protection systems to be used;    (c)  The use and operation of guardrail systems, personal fall arrest systems, safety net systems, warning line systems, safety monitoring systems, controlled access zones, and other protection to be used;     (d)  The role of each employee in the safety monitoring system when this system is used;    (e)  The limitations on the use of mechanical equipment during the performance of roofing work on low-sloped roofs;    (f)  The correct procedures for the handling and storage of equipment and materials and the erection of overhead protection; and    (g)  The role of employees in fall protection plans;    (h)  The standards contained in this subpart.    Abatement Note: 1926.503(b)(1) provides that the employer shall verify compliance with paragraph (a) of this section by preparing a written certification record. The written certification record shall contain the name or other identity of the employee trained, the date(s) of the training, and the signature of the person who conducted the training or the signature of the employer. If the employer relies on training conducted by another employer or completed prior to the effective date of this section, the certification record shall indicate the date the employer determined the prior training was adequate rather than the date of actual training.

1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landingsurface to which the ladder was used to gain access and the ladder wasnot secured at its top to a rigid support, and a grasping device, such as agrabrail, was not provided to assist the employees in mounting and dismounting the ladder    (a)  Rockridge Building Company @ 5245 Galena St., Frisco, CO 80443: On and before April 5th, 2011, the employer did not ensure that employees were utilizing portable lA-frame ladders in such a way that enabled them to access and egress from work areas using ladders that extended 3' did not extend 3 feet over the roof line allowing employees a smooth transition from the roof to the ladder. Employees were exposed to a fall of approximately 11 feet to 38 feet while attempting to use the ladder.

29 CFR 1926.1053(b)(4):  Ladders were used for purposes other than the purposes for which they were designed:    (a)  Rockridge Building Company @ 5245 Galena St., Frisco, CO 80443:  On and before April 5th, 2011, the employer allowed employees to utilize a closed A-frame ladder to gain access to the main roof to conduct roofing activity. The specific use of not opening and locking the spreaders while using the ladder is contrary to the manufacturer's instuctions. This hazard exposed the employee to a fall of approximately 11 feet to 38 feet..

29 CFR 1926.1060(a): The employer did not provide a training program for each employee using ladders and stairways which would train each employee in the procedures to be followed to minimize hazards related to ladders and stairways:    (a)  Rockridge Building Company @ 5245 Galena St., Frisco, CO 80443: On and before April 5th, 2011, the employer did not ensure employees were provided training to recognize hazards related to ladders. The lack of training exposed employees to fall hazards of approximately 10 feet.    Abatement Note:  The employer shall ensure that each employee has been trained in the following areas:   (1)  The nature of fall hazards in the work area.   (2)  The correct procedure for erecting and maintaining ladders.    (3)  The proper construction, use, placement, and care in handling of all ladders.   (4)  The maximum intended load capacity of the ladders used by Rockridge Building Company.   (5)  The applicable parts of 29 CFR 1926 subpart X.
