29 CFR 1926.200(g)(2):  The employer did not ensure that all traffic control signs or devices used for protection of construction workers conformed to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000:         a)  Q3 Contracting, Inc. at Jewell Ave. and Lafayette St., Denver, CO 80201:  On or before April 26, 2011, the employer did not ensure that warning signs conformed to the MUTCD in that employees had dug a trench near the middle of the intersection of Jewell Ave. and Lafayette Street, and no advanced warning signs were in place on the north and south sides of Lafayette Street, nor on the east side of Jewell Avenue.  In addition, access to Jewell Avenue was closed off at Humbolt Street, and there were no advanced warning signs on the north and south sides of Humbolt Street.  Finally, the east-bound access to Jewell was closed off at Downing Street, and there were no advanced warning signs on the north and south sides of Downing Street.  Employees were drilling a new natural gas pipeline, with this segment about 400 feet long.  Condition exposed employees to struck-by hazards.    Abatement note:  Abatement certification is required for this item (see enclosed, "Sample Abatement-Certification Letter").    Abatement note:  The MUTCD Section 6B.01 provides that the control of road users through a temporary traffic control zone shall be an essential part of highway construction, utility work, maintenance operations, and incident management.  Sections 6C.03 and 6C.04 discuss the requirements associated with advanced warning areas, providing that the advanced warning area is that section of the road where users are informed about the upcoming work zone or incident area.  Typical Applications 18 illustrates a Lane Closure for a Minor Street, applicable to Lafayette Street and Jewell Avenue.  Typical Application 20 illustrates a Detour for a Closed Street, and is applicable for the other intersections involving the closure of Jewell Avenue.

29 CFR 1926.202:  The employer did not ensure that all barricades used for protection of construction workers conformed to Part VI of the Manual on Uniform Traffic Control Devices (MUTCD) Millennium Edition, December 2000:         a)  Q3 Contracting, Inc. at Jewell Ave. and Lafayette St., Denver, CO 80201:  On or before April 26, 2011, the employer did not ensure that the barricades conformed to the MUTCD in that employees had dug a trench near the middle of the intersection of Jewell Ave. and Lafayette Street, and no tapers was in place for southbound traffic entering the instersection on Lafayette Street.  In addition, the cone set next to the front fender of the truck for northbound traffic on Lafayette did not protect employees working in the bed of the truck and behind the truck.  There was no additional taper in front of the truck.  Condition exposed employees to struck-by hazards.    Abatement note:  Abatement certification is required for this item (see enclosed, "Sample Abatement-Certification Letter").    Abatement note:  The MUTCD Section 6C.08 discusses the requirements associated with temporary traffic control zones, including the use of tapers with channelizing devices to move traffic out of or into normal paths.  Section 6F.55 describes the use of cones and other barricades to serve as channelizing devices.
