Section 5(a) (1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to vehicular struck by hazards due to the defective brakes on a 2000 International 4700/T444E 28 foot truck: C.O. Delivery, 510 E. 51st Ave., Denver, CO 80216: On and before May 4, 2011, the exposing employer did not ensure adequate vehicular inspections and required maintenance were performed on a 2000 International 4700/T444E truck, Colorado License Plate 804-SGG, DOT Number 26572, utilized to make package deliveries. Lack of adequate inspections and maintenance resulted in the vehicles parking brake wearing to the point that it resulted in its failure as an employee attempted to park the vehicle, engage the emeregency brake, and make a delivery. This condition resulted in the vehicles brake system failing and the vehicle moving and subsequently pinning the employee to another vehicle and fataly injurying him. \r\n\r\nNote: Abatement certification and documentation are required for this item (See enclosed \\\\\\\"Sample Abatement-Certification Letter\\\\\\\").
