Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees exposed to a potential struck-by hazard: (a) At TJN Enterprises located in Sioux Falls, SD, where on or about April 28th, 2011, an employee working in the scrap yard was exposed to the potential hazard of being struck by vehicles entering the scrap yard. Among other methods, one feasible and acceptable abatement method to correct this hazard is to develop and implement a comprehensive traffic control plan that addresses struck-by hazards presented by all sources, including but not limited to company-owned vehicles, customers and contractors. This plan would also include the feasibility of physical barriers and methods of communication between vehicles and employees.
