29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM was begun, the employer did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of this section: (a) KTK General Contracting Limited at 3333 S Colorado Blvd, Denver, CO 80222: On and before April 6, 2011, the employer did not, before work in areas containing ACM and PACM was begun, determine the presence, location, and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section. Subcontractors performed remodeling work on the first floor holding area (Onyx and Veranda rooms) of the facility. Presence, location, and quantity of ACM and PACM building materials such as, but not limited to, drywall surface texturing were not determined prior to the start of work. This condition potentially exposed the employees to an asbestos hazard. Abatement Note: Abatement certification is required for this item (see enclosed Sample Abatement Certification Letter).

29 CFR 1926.1101(k)(3)(ii)(B): Before work under this standard was performed, the employer of employees who will perform such work did not inform employees and employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area: (a) KTK General Contracting Limited at 3333 S Colorado Blvd, Denver, CO 80222: On and before April 6, 2011, before work under this standard was performed, the employer did not inform employees and employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area. Employees and subcontractors performed remodeling work on the first floor holding area (Onyx and Veranda rooms) of the facility.
