CFR 1926.451(c)(2)(i): Employer did not ensure that footings were level, sound, rigid, and capable of supporting the loaded scaffold without settling or displacement. (a) McMahon Masonry, 1031 33rd Street, Denver, CO 80204: On and before May 17, 2011, the employer did not ensure that the footing on an 18 foot tall tubular scaffold utilized by two employees was adequately level to protect the employees from injury due to the scaffold shifting or moving. Specifically, the scaffolds footing nearest the face of the building was on an approximately 2 degree decline and the footing was not adjusted to match this declination. Condition exposed two employees performing brick work off the scaffolding to fall hazards of approximately 13 feet. Abatement Note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

CFR 1926.451(g)(1): Each employee on a scaffold more than 10 feet (3.1 m) above a lower level was not protected from falling to that lower level. (a) McMahon Masonry, 1031 33rd Street, Denver, CO 80204: On and before May 17, 2011, the employer did not ensure that the two employees performing masonry work off a tubular scaffold system were protected from falling by ensuring that scaffold had and adequate guard rail system on the back and sides of the work platform. Condition exposed employees working off the scaffolding to fall hazards of approximately 13 feet.

Condition exposed employees to struck by hazards from falling debris off the working platform.
