29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Renove Construction, Inc. @ 5030 2nd St., Boulder, CO 80301: On and before May 14th, 2011, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approx feet and 9 feet. Abatement Note: Abatement certification is required for this item (see enclosed Abatement-Certification Letter"). Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

(a)Renove Construction, Inc. @ 5030 2nd Street, Boulder, CO 80301: On and before May 14th, 2011, the employer did not ensure that fall protection systems were utilized by employees engaged in framing activities while working at the unprotected edges of the first level of a single-family home under construction. Employees were exposed to fall hazards of approximately 9'.

1926.1053(b)(1): Because of the portable ladder's length, the ladder side rails did not extend to at least 3 feet (.9 m) above the upper landing surface to which the ladder was used to gain access and the ladder was not secured at its top to a rigid support, and a grasping device, such as a grabrail, was not provided to assist the employees in mounting and dismounting the ladder (a) Renove Construction, Inc. @ 5030 2nd St., Boulder, CO 80301: On and before May 14th, 2011, the employer did not ensure that employees were utilizing portable ladders in such a way that enabled them to access and egress from work areas using ladders that extended 3' above the walking working surface. Employees were using a portable extension-ladder for access to the second floor. Employees were exposed to a fall of approximately 9' while attempting to use the ladder.
