29 CFR 1910.1200(h)(3)(ii): Employee training did not include at least the physical and health hazards of the chemcials in the work area: (a) On and prior to May 17, 2011, the employer did not ensure that employees were trained in the physical and health hazards of the concrete slurry created by wetting and cutting ready mixed concrete. Chemicals include, but are not limited to silica, lime slurry and hexavalent chromium.

29 CFR 1926.95(a): The employer failed to provide and maintain protective equipment, including personal protective equipment for protective clothing in a sanitary and reliable condition wherever it is necessary by reason of chemical hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through absorption or physical contact: (a) Russ T. Diamonds, Inc., 11008 Pearl Circle, Northglenn, CO 80233: On or before May 17, 2011, the employer failed to provide protective clothing in a sanitary and reliable condition when working with ready mix concrete (portland cement slurry). Employees protective clothing consisited of pants and a long-sleeved shirt which was wet and soiled with cement. The MSDS for Ready Mix Cement also states that clothing be impervious to water to prevent skin contact. This condition exposed employees to chemical hazards. (b) Russ T. Diamonds, Inc., 11008 Pearl Circle, Northglenn, CO 80233: On or before May 17, 2011, the employer failed to maintain protective coveralls in a sanitary and reliable condition when working with ready mix concrete (portland cement slurry). Coveralls/Rain gear were not being worn by employees, were found in the front of the vehicle, fully soiled with cement slurry, a highly caustic and hazardous chemical created by concrete saw work. This condition exposed employees to chemical hazards.

29 CFR 1926.102 (a)(2): The employer did not make sure that eye protection equipment met the requirements specified in American National Standards Institute (ANSI), Z87.1-1968, Practice for Occupational and Educational Eye and Face Protection: (a) Russ T. Diamonds, Inc., 11008 Pearl Circle, Northglenn, CO 80233: On or before May 17, 2011, the employer did not provide employees with eye protection equipment that met the requirements specified in American National Standards Institute (ANSI), Z87.1-1968, Practice for Occupational and Educational Eye and Face Protections. (ANSI), Z87.1-1968 recommends either goggles, welding goggles, or chipping goggle be worn during chemical splash and heavy grinding work.

29 CFR 1910.1200(g)(10): The employer did not ensure that MSDSs were readily available to employees during each work shift when they were in their work areas: (a) Russ T. Diamonds, Inc., 11008 Pearl Circle, Northglenn, CO 80233: On or before May 17, 2011, the employer did not ensure that employees could obtain a MSDS while at their work area. It was reported that MSDSs are keep in the owners shop office and not at different job locations. This condition exposed employees to chemical hazards. Abatement Note: The requirements applicable to construction work, under this section are identical to those set forth at 1910. 1200.
