29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502. a) Southwest roof hip and roof trusses at 2nd level; On or about 5/20/11 and at times prior thereto, three employees tying the trusses together at the hip were inbetween the trusses and/or up on the truss top cord without a means of fall protection. b) West side of structure at transition area of 1st to 2nd story; On or about 5/20/11 and at times prior thereto, an employee installing/nailing wall sheathing was working from the top of the exterior wall. Note: Abatement certification is NOT required for this item.

29 CFR 1926.1053(b)(5)(i): Non-self-supporting ladder(s) were not used at an angle such that the horizontal distance from the top support to the foot of the ladder was approximately one-quarter of the working length of the ladder (the distance along the ladder between the foot and the top support). a) West side of structure at transition area of 1st to 2nd story; On or about 5/20/11 and at times prior thereto, an employee installing/nailing wall sheathing was working from an extension ladder placed in a 60 degree angle. Note: Abatement certification is NOT required for this item.
