29 CFR 1926.1101(d)(1): On multi-employer worksites, the employer performing work requiring the establishment of regulated areas did not inform other employers on the site of the nature of the employers work with asbestos and/or PACM, of the existence of and requirements pertaining to regulated areas, and the measures taken to ensure that employees of such other employers were not exposed to asbestos: (a) Punch Bowl LLC at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, the employer performing work requiring the establishment of a regulated area did not inform other employers on the site of the nature of the employers work with asbestos and/or PACM, of the existence of and requirements pertaining to regulated areas, and the measures taken to ensure that employees of such other employers were not exposed to asbestos. Contractors performed demolition work on the main floor and mezzanine levels of the facility. Demolition activities included, but were not limited to, removal of thermal system insulation and textured surfacing material. Bulk analysis determined that these materials contained up to 75% asbestos. Other employers were not informed of the nature of work with asbestos and/or PACM, the requirement to establish a regulated area, and the measures needed to be taken to ensure employees of such employers were not exposed to asbestos. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1926.1101(k)(2)(ii): The building and/or facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing or a personal communication: (a) Punch Bowl LLC at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, the building and/or facility owner did not inform all employers of employees who worked within or adjacent to the areas containing ACM and PACM of the presence, location, and quantity of these materials. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
