29 CFR 1926.1101(k)(3)(i): Before work in areas containing ACM and PACM was begun, the employer did not identify the presence, location, and quantity of ACM, and/or PACM therein pursuant to paragraph (k)(1) of 29 CFR 1926.1101:\r\n(a) Labor Ready Central Inc at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, the employer did not, before work in areas containing ACM and PACM was begun, determine the presence, location, and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section. Employees performed demolition work of the interior structure of the facility. Demolition activities included, but is not limited to, removal of thermal system insulation and textured surfacing material. Employees used hammers, grinders, and prybars to perform demolition work. Pipe insulation and textured drywall wall and ceilings were found to contain asbestos in quantities greater than 1%. Furthermore, employees transferred demolition debris to dumpsters for removal. Demolition debris was found to contain asbestos in quantities greater than 1%. Presence, location, and quantity of ACM and PACM building materials such as, but not limited to, insulation and surface texturing were not determined prior to the start of work. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet ).

29 CFR 1926.1101(k)(3)(ii)(B): Before work under this standard was performed, the employer of employees who will perform such work did not inform employees and did not inform employers of employees who worked and/or were working in adjacent areas of the location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) present in the area and the precautions to be taken to insure that airborne asbestos is confined to the area: (a) Labor Ready Central Inc at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, before work under this standard was performed, the employer did not inform employees of the presence, location, and quantity of ACM and/or PACM in the facility. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet ).
