29 CFR 1926.451(e)(1): When scaffold platforms were more than 2 feet (0.6 m) above or below a point of access, portable ladders, hook-on ladders, attachable ladders, stair towers (scaffold stairways/towers), stairway-type ladders (such as ladder stands), ramps, walkways, integral prefabricated scaffold access, or direct access from other scaffold, sturcure, personnel hoist, or similar surface was not used:    a) Jobsite: On May 23, 2011 and times prior thereto employees used self supporting A-framed ladders in the closed position for access to the lower level and for access between the upper levels of the scaffold. 29 CFR 1926.454(b)(2): The employer did not have each employee trained by a competent person for the correct procedures for erecting, disassembling, moving, operating, repairing, inspecting, and maintaining the type of scaffold in question:    a) Jobsite: On May23, 2011 and times prior thereto employees performing stucco activities on a tubular welded frame scaffold sysytem did not recognize the hazard(s) of not having a complete guardrail system in place, and take actions to minimize the hazard.     b)  Jobsite: On May23, 2011 and times prior thereto employees performing stucco activities on a tubular welded frame scaffold sysytem did not recognize the hazard of working on the upper levels that were not fully decked or planked, and take actions to minimize the hazard.     c) Jobsite: On May23, 2011 and times prior thereto employees performing stucco activities on a tubular welded frame scaffold sysytem did not recognize the hazard of not having safe access to all working levels of the scaffold system, and take actions to minimize the hazard.     d) Jobsite: On May23, 2011 and times prior thereto employees performing stucco activities on a tubular welded frame scaffold sysytem did not recognize that the scaffolld legs/frames were not all on base plates, mud sills or other adequate firm foundation, and take actions to minimize the hazard. 29 CFR 1926.451(g)(4)(iv): Midrails were not installed at a height approximately midway between the top edge of the guardrail system and the platform surface:    a) Jobsite: On May 23, 2011 and times prior thereto employees performed stucco activities on the upper levels of the scaffold without a complete guardrail system in place.      Note 1) 29 CFR 1926.451(g)(xv) states crossbracing is acceptable in place of a midrail when the crossing point of two braces is between 20 inches (0.5 m) and 30 inches (0.8 m) above the work platform or as a toprail when the crossing point of two braces is between 38 inches (0.97 m) and 48 inches (1.3 m) above the work platform. The end points at each upright shall be no more than 48 inches (1.3 m) apart.    Note 2) Abatement certification is required for this item.
