29 CFR 1926.1053(b)(1): When portable ladders are used for access to an upper landing surface, the ladder side rails shall extend at least 3 feet (.9 m) above the upper landing surface to which the ladder is used to gain access; or, when such an extension is not possible because of the ladder's length, then the ladder shall be secured at its top to a rigid support that will not deflect, and a grasping device, such as a grab rail, shall be provided to assist employees in mounting and dismounting the ladder. In no case shall the extension be such that ladder deflection under a load would, by itself, cause the ladder to slip off its support. On or about May 23, 2011, at a jobsite located at 11511 S. Michigan Avenue, Chicago, Illinois - the portable ladder used to access the work zone did not extend at least three (3) feet above the upper landing surface, thereby exposing employees to fall hazards of approximately twenty five (25) to thirty five (35) feet.

29 CFR 1926.501(b)(1): "Unprotected sides and edges." Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level shall be protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. On or about May 23, 2011, at a jobsite located at 11511 S. Michigan Avenue, Chicago, Illinois - employees engaged in demolition operations on the roof were exposed to fall hazards of approximately twenty five to thirty five (35) feet, created by the presence of unprotected sides and edges. The Sciortino Group, Inc. was previously cited for a violation for this Occupational Safety and Health Standard or its equivalent Standard, 29 CFR 1926.501(b)(1), which was contained in OSHA Inspection Number 312599335, Citation Number 1 Item Number 1 and was affirmed as final order on November 5, 2009 with respect to the workplace located at 3745 S. Indiana Avenue, Chicago, IL 60653.
