Employer did not adequately train employee operator on how to utilize load capacity charts and specifically when and where the charts applied.  Employer did not inform employee operator of the location of the operator's manual stored on the forklift nor did employer incorporate the manual's contents into the training.  This condition exposed employees to the hazards of unsafe fork-lift operations resulting in equipment tip over.

29 CFR 1910.178(l)(3)(ii)(A): Powered industrial truck operators did not receive, as part of their initial training, workplace-related subject matter pertaining to surface conditions where the vehicle will be operated:           (a)    Lowes at 16570 Umpire Ct., Hudson, CO 80642:  On and before May 24, 2011, the employer did not ensure all forklift operators were trained in operation of powered industrial trucks in that the operators were not adequately trained in the use of the Moffett Mounty, Model M5500, Serial # C27101 forklift prior to its use at an offsite location. Delivery employees received training only for ideal surface conditions (i.e., firm level surface of a parking lot) which are not consistent with the anticipated varying surface conditions encountered at delivery work sites.  The operator, while carrying an 88% maximum load, was maneuvering the fork-lift on soft, sloped ground while extending the mast and load forward without the use of the units stabilizers.  Employer did not adequately train employee operator on the safe operation of the forklift when encountering the varying surface conditions at delivery sites.  This condition exposed employees to the hazards of unsafe fork-lift operations resulting in equipment tip over.

The operator was carrying an 88% maximum load for the condition of "stabilizers raised mast retracted".  The operator, while attempting to place the load on the ground, changed the condition of the forklift to "stabilizers raised mast extended" and under this condition the forklift's carrying capacity was exceeded by a factor of greater than 3 times.  This condition exposed employees to the hazards of unsafe fork-lift operations resulting in equipment tip over.
