29 CFR 1910.146(d)(9): The employer did not develop and implement procedures for summoning rescue and emergency services, for rescuing entrants from permit spaces, for providing necessary emergency services to rescued employees, and/or for preventing unauthorized personnel from attempting a rescue:    (a)  Commerce City Grain, LLC at 4600 E. 64th Ave., Commerce City, CO 80022:    The employer did not develop and implement procedures for summoning rescue and emergency services to rescue employees from permit spaces when necessary. In that, the rescue procedures in the company program for personal entry into confined spaces does not include the necessary contact information for emergency services and did not ensure the rescuers ability to ensure a timely and successful rescue.  This condition exposed the employees to the hazards associated with permit required confined spaces at the facility not to include entry into bins, silos, tanks and other grain storage structures.  Abatement Note:  An employer who designates rescue and emergency services, pursuant to paragraph (d)(9) of this section, shall:  (a)	Evaluate a prospective rescuer's ability to respond to a rescue summons in a timely manner, considering the hazard(s) identified;  (b)	Evaluate a prospective rescue service's ability, in terms of proficiency with rescue-related tasks and equipment, to function appropriately while rescuing entrants from the particular permit space or types of permit spaces identified;  (c)	Select a rescue team or service from those evaluated that:  (1)	Has the capability to reach the victim(s) within a time frame that is appropriate for the permit space hazard(s) identified;  (2)	Is equipped for and proficient in performing the needed rescue services;  (3)	Inform each rescue team or service of the hazards they may confront when called on to perform rescue at the site; and   (4)	Provide the rescue team or service selected with access to all permit spaces from which rescue may be necessary so that the rescue service can develop appropriate rescue plans and practice rescue operations.

29 CFR 1910.272(j)(1): The employer did not develop and implement a written housekeeping program that established the frequency and method(s) determined best to reduce accumulations of fugitive grain dust on ledges, floors, equipment, and other exposed surfaces:    (a)Commerce City Grain LLC at 4600 E. 64th Ave., Commerce City, CO 80022:  The employer did not develop and implement a written housekeeping program to meet the requirements of the standard in that the housekeeping program was a generic program and did not establish frequency to reduce accumulations of fugitive dust.  Because of this violation, the employer provided no direct policy which resulted in accumulation of fugitive dust in, but not limited to, the galleries over the old and new side and the tunnel under the old side and buildup of spilled product in, but not limited to the cleaner and tunnel under the old side.
