29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected from falling:         a)  Maravilla, Armando R. dba Juanitos Const. at 3527 Akron Ct., Denver, CO 80238:  On or before 5/21/11, the employer did not ensure that employees were protected by guardrails, personal fall arrest systems, or safety nets, in the following instances:         1)  An employee was framing on the second floor by standing on a plant platform with estimated dimensions of 40" x 72", and this employee was not wearing a personal fall arrest system and guardrails were not in place, providing falls to the ground of about 12';         2)  Employees were working on the main floor where an open landing, measuring 50" x 72", provided exposure to falls to the basement of 12'; and         3)  Six window openings were not properly guarded on the second floor, including four 36" high x 24" wide, and two 30" high and 36" wide, providing falls to the ground of about 12'.    Conditions exposed employees to fall hazards of about 12'.    Abatement note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
