29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):\\r\\n(a) Bell Plumbing and Heating Co. at 1378 Forest St, Denver, CO 80220: On and before June 4, 2011, the exposing employer did not ensure that each employee installing a new sewer line inside an excavation that measured approximately 10 feet in depth was protected from cave-in. Two employees worked in the excavation located in the middle of the street without using a complete protective system. An aluminum shoring panel system was used on the east and west sides of the excavation. The south side of the excavation was unprotected. An aluminum shoring panel located inside the excavation was placed against the north side wall; however, this panel was not connected to a protective system. This condition exposed the employee to a crushing hazard by excavation wall cave-in.\\r\\n

29 CFR 1926.652(e)(2)(i): Excavation of material to a level no greater than 2 feet below the bottom of the members of the support system was allowed when there were indications while the trench was open of a possible loss of soil from behind or below the bottom of the support system:\\r\\n(a) Bell Plumbing and Heating Co. at 1378 Forest St, Denver, CO 80220: On and before June 4, 2011, the exposing employer did not ensure the excavation of material to be no greater than 2 feet below the bottom of the members of the support system. Soil was removed more than 5 feet below the bottom of the aluminum shoring panels on the west and east sides of the excavation. This condition exposed subcontractor employees to the potential of a protective system failure.
