29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them): (a) Bullzeye Builders, Inc. @ 6572 Murano Dr., Windsor, CO 80550: On and before May 28th, 2011, the employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approx feet and 10 feet. Abatement Note: Abatement certification is required for this item (see enclosed Abatement-Certification Letter"). Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor was an alternative fall protection measure provided. (a)Bullzeye Builders, Inc. @ 6572 Murano Dr., Windsor, CO 80550: On and before May 28th, 2011, the employer did not ensure that fall protection systems were utilized by employees engaged in framing activities while working at the unprotected edges of the second floor on a single-family home. Employees were not utilizing a fall protective system. The condition exposed employees to a fall hazard of approximately 10 feet.
