29 CFR 1926.501(b)(13): "Residential construction." Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels were not protected by guardrail systems, safety net system, or personal fall arrest system unless another provisionin paragraph (b) of this section provides for an alternative fall protection measure. Exception: When the employer can demonstrate that it isinfeasible or creates a greater hazard to use these systems, the employer did not develop and implement a fall protection plan which meets therequirements of paragraph (k) of 1926.502.Note: There is a presumption that it is feasible and will not create a greater hazard to implement at least one of the above-listed fallprotection systems. Accordingly, the employer has the burden of establishing that it is appropriate to implement a fall protection plan which complieswith 1926.502(k) for a particular workplace situation, in lieu of implementing any of those systems. On June 8, 2011 employees were not protected from a fall as the roofed a residential like property, exposing them to a fall hazards between 9.4 and 21.10 feet. J & J Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 501(b)(13) which was contained in inspection number 311521581, citation number 01, item number 01, issued on 08/26/08, with respect to a workplace located at 471 Melrose Ct. Elgin, IL. J & J Roofing and Construction, Inc. was previously cited for a violation of this occupational safety and health standard or its equivalent standard 29 CFR 501(b)(13) which was contained in inspection number 309157790, citation number 02, item number 02, issued on 08/09/05, with respect to a workplace located at 1224 Buena Terrace Antioch, IL.
