29 CFR 1926.760(a)(1): Except as provided by paragraph (a)(3) of this section, each employee engaged in a steel erection activity who is on a walking/working surface with an unprotected side or edge more than 15 feet (4.6m) above a lower level was not protected from fall hazards by guardrail systems, safety net systems, personal fall arrest systems, position device systems or fall restraint systems: a) On or about June 1, 2011, Colarelli Construction Company, Inc., as controlling employer, did not ensure that ABC Welding & Construction, Inc., protected their employees from falls in excess of 15 feet while welding on a ski lift without using fall protection. b) On or about June 1, 2011, Colarelli Construction Company, Inc., as controlling employer, did not ensure that ABC Welding & Construction, Inc., protected their employees from falls in excess of 15 feet an employee climbed onto the midrail of an aerail lift to weld on the ski lift. Abatement Note: Abatement certification and documentation is required for this item (see enclosed "Sample Abatement-Certification Letter").
