29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):     (a)Evans Chafee Construction Corp @ 34999 Hwy 6 # 926, Edwards, CO 81632: On and before June 3rd, 2011 the controlling employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Subcontractor employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approx feet and 29 feet.    Evans Chafee Construction Corp was previously cited for a violation of the same or substantially similar condition of this Occupational Safety and Health Standard 29 CFR 1926.20(b)(2) which was contained in OSHA Inspection Number 313412876, Citation Number 1, Item 1a issued on October 8th, 2009, and became Final Order on November 26th, 2009, with respect to a workplace located at 600 Columbine Road, Breckenridge, CO 80424.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.    (a)Evans Chafee Construction Corp @ 34999 Hwy 6 # 926, Edwards, CO 81632:  On and before June 3rd, 2011, the controlling employer did not ensure each subcontractor employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that subcontractor employees were engaged in framing and sheathing operations on the roof of the Vail Mountain Rescue project without the use of a fall protection system. This condition exposed subcontractor employees to fall hazards of approximately 29 feet.

29 CFR 1926.1052(c)(1): Stairways having four or more risers or rising more than 30 inches (76 cm), whichever is less, were not equipped with one handrail and one stairrail system along each unprotected side or edge:    (a)Evans Chafee Construction Corp @ 34999 Hwy 6 # 926, Edwards, CO 81632:@ 34999 Hwy 6 # 926, Edwards, CO 81632:On and before June 3rd, 2011, the controlling employer did not ensure that the interior stairway inside the building under construction, being used by subcontractor employees to gain access to the second level, rising approximately 14 feet, was equipped with an adequate stairrail system. The top stairrail and midrail were not appropriately installed, along with the intermediate vertical members. Employees utilizing the stairs to reach the second level of the home were exposed to fall hazards of approximately 14'.

29 CFR 1926.1052(b)(1): Except during stairway construction, foot traffic is prohibited on stairways with pan stairs wherethe treads and/or landings are to be filled in with concrete or other material at a later date, unless the stairs are temporarily fitted with wood orother solid material at least to the top edge of each pan. Such temporary treads and landings shall be replaced when worn below the level of the topedge of the pan.
