29 CFR 1926.20(b)(2): The employer did not initiate and maintain a safety program which provides for frequent and regular inspections of jobsites, materials, and equipment to be made by a competent person (i.e., a person who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has the authority to take prompt corrective measures to eliminate them):    (a) RD Clark Drywall, Inc. @ 333 N. 1st Street, Grand Junction, CO 81501:  On and before June 2nd, 2011 the exposing employer did not ensure a safety program was developed and implemented for the work environment to include regular inspections of the job-site, materials, and equipment; conducted by a competent person. Employees on-site were permitted to work in areas where fall hazards existed. The condition exposed employees to fall hazards of approximately feet and 12 feet.    Abatement Note: OSHA defines a "competent" person as one who is capable of identifying existing and predictable hazards in the surroundings or working conditions which are unsanitary, hazardous, or dangerous to employees, and who has authorization to take prompt corrective measures to eliminate them.

29 CFR 1926.451(b)(1):  Each platform on all working levels of scaffolds were not fully planked or decked between the front uprights and the guardrail supports:    (a) RD Clark Drywall, Inc. @ 333 N. 1st Street, Grand Junction, C0 81501:  On and before June 2nd, 2011, the exposing employer did not ensure the working platform on the fabricated frame scaffold was fully planked, in that the employee was working off one scaffold plank and the working level was not fully planked where the employee was installing lathe and stucco. This condition exposed the employee to a fall of approximately 12 feet.

29 CFR 1926.451(g)(1):  Each employee on a scaffold 10 feet above a lower level was not protected from falling to the lower level:    (a) RD Clark Drywall, Inc. @ 333 N 1st Street, Grand Junction, CO 81501:  On and before June 2nd, 2011, the exposing employer did not ensure that employees were protected from a fall from elevation, in that guardrails or other suitable fall protection were not properly installed on the working platform of the scaffolding. The scaffold system erected to conduct lathe and stucco installation was utilizing a crossbrace to prevent falls to the exterior of the system. This condition exposed an employee to fall of approximately 12 feet.

29 CFR 1926.501(b)(1):  Each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was not protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system.    (a)RD Clark Drywall, Inc. @ 333 N. 1st Street, Grand Junction, CO 81501:  On and before June 2nd, 2011 the exposing employer did not ensure each employee on a walking/working surface having an unprotected side or edge which was six feet (1.8m) or more above a lower level was protected from falling by the use of a guardrail system, a safety net system, or personal fall arrest system in that subcontractor employees were engaged in lathe and stucco installation on the roof of a commercial building without fall protection. This condition exposed the employees to a fall hazard of approximately 12 feet.
