Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards which were likely to cause death or serious physical harm from injury in that, employees were exposed to the hazards of asphyxiated while entering and working inside of a manhole: a) On or about June 7, 2011 and at times prior, employees were exposed to iserious hazards while working in a manhole. The manhole was entered under the following conditions: 1) without purging, inerting, flushing or ventilating the space; 2) without verifying that the condition in the space were acceptable for entry throughout the duration of entery; 3) without retrieval equipment in event of an emergency; and 4) without utilizing the permit system. Among other methods, one feasible and acceptable method to correct this hazardous condition includes, but is not limited to, the full implementation of the elements required by the American National Standards Institute (ANSI) Z117.1 (Safety Requirments for Confined Space).
