29 CFR 1910.23(c)(2):  The employer did not ensure that each runway/catwalk was guarded by a standard railing (or the equivalent as specified in paragraph(e)(3) of this section) on all open sides 4 feet or more above floor or ground level:\r\n\r\n(a) At Dakota Ag Cooperative in Kindred, ND, where parts of the guardrail had been removed on the runway/catwalk adjacent to the upper conveyor to facilitate the installation of piping and exposed employees to a potential fall hazard of approximately 50 feet.

29 CFR 1910.272(e)(1): The employer did not provide training to employees at least annually and when changes in job assignments would expose them to new hazards in the grain handling facilities:    (a)  At Dakota Ag Cooperative in Kindred, ND, where on or about 06/09/11, and at times prior, employees had not received specific training in the methods and procedures to be followed when pushing corn in the flat grain storage building exposing employees to a potential engulfment hazard.
