29 CFR 1926.1101(d)(2): Asbestos hazards at a multi-employer work site were not abated by the contractor who created or controls the source of asbestos contamination: As of June 16, 2011, asbestos hazards at the site were not controlled by assigning the asbestos abatement contractor to remove ACM or PACM before assigning other subcontractors to tasks that have the potential to disturb ACM or PACM.

29 CFR 1926.1101(k)(7)(iii): The employer did not ensure that employees working in and contiguous to regulated areas comprehend the warning signs required to be posted by 29 CFR 1926.1101(k)(7)(i): a. On the 2nd floor perimeter walls where the wall plaster is PACM, warning signs were not posted. Employees were assigned to frame windows in these walls, including but not limited to the west wall, without the walls having signs or other indications that they were PACM. b. In the 5th floor electrical room (south side), warning signs for asbestos were posted after employees had performed electrical work which disturbed the wall plaster. The asbestos survey was later revised to show this wall plaster as non-asbestos-containing material.
