29 CFR 1926.251(e)(8)(iii): Synthetic slings were not immediately removed from service when snags, punctures, tears or cuts were present: a) Aguinaga, Abraham dba Abraham Const. at 1073 Copper Hill Ct., Louisville, CO 80027: On or before 6/18/11, the employer did not ensure that a Cable Tech synthetic sling, serial number 101187, was removed from service when tears or cuts were present on two places on the sling, evidenced by red thread. Employees were using this rigging to connect to and disconnect from loads of OSB sheathing consisting of 68 4'x 8' sheets and weighing 3,500 pounds per load, and the employees were standing in the fall zone of these loads. Conditions exposed employees to struck-by hazards. Abatement note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.1425(c)(3): When employees are engaged in hooking, unhooking, or guiding the loads, or in the initial connection of the loads to a component or structure and are within the fall zone, the material was not rigged by a qualified rigger: a) Aguinaga, Abraham dba Abraham Const. at 1073 Copper Hill Ct., Louisville, CO 80027: On or before 6/18/11, the employer did not ensure that employees engaged in hooking and unhooking the loads were qualified riggers. The employees were not qualified to inspect the damaged synthetic rigging and to make decisions on its use at the jobsite. Employees were using damaged synthetic rigging to connect to and disconnect from loads of OSB sheathing consisting of 68 4'x 8' sheets and weighing 3,500 pounds per load, and the employees were standing in the fall zone of these loads. Conditions exposed employees to struck-by hazards. Abatement note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").

29 CFR 1926.404(f)(6): The path to ground from circuits, equipment, or enclosures was not permanent and continuous: a) Aguinaga, Abraham dba Abraham Const. at 1073 Copper Hill Ct., Louisville, CO 80027: On or before 6/18/11, the employer did not ensure that the path to ground from was permanent and continuous in the following instances: 1) The ground plug for the Dewalt skilsaw, model 535, was broken off; and 2) A yellow extension cord had its ground plug broken off. Both the skilsaw plug and the extension cord were used to power the 110 volt Dewalt skilsaw model 535 that was not double insulated, but was on a ground fault circuit interrupter (GFCI). Conditions exposed employee to electrical shock hazards. Abatement note: Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter").
