29 CFR 1910.178(l)(4)(iii): An evaluation of each powered industrial truck operator's performance was not being conducted at least once every three years: a) The Mohawk Company dba Metal Coating Company, Lima, Ohio: On or about June 13, 2011, the employer did not ensure that the performance of all employees operating powered industrial vehicles, such as, but not limited to the Daewoo (Serial #CV-01475) and Mitsubishi model FGC30K (Serial #AF83E00077) were evaluated at least once every three years. The forklifts were routinely used to unload truck trailers and to transport materials throughout the facility.

29 CFR 1910.178(o)(2): Load(s) were being handled which exceeded the rated capacity of the industrial truck(s): a) The Mohawk Company dba Metal Coating Company, Lima, Ohio: On or about June 1, 2011, the employer did not ensure that only loads within the rated capacity of the forklifts were lifted. While removing bundles of stock from truck trailers, lift trucks were overloaded to the point that employees stood on the back of the Daewoo Forklift (Model GC25E, Serial #CV-01475) to provide additional counterweight. Employees were exposed to crushing and falling hazards.
