29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: a) On or about May 17, 2011, Strathmore Homes, Inc., as the controlling employer, did not ensure that San Buena Construction, a sub-contractor, protected their employees from falls in excess of 10 feet from the ground while standing on the outer plate attaching a frame to the wall, and while attaching gables to the roof without fall protection.

29 CFR 1926.1053(b)(13): The top or step of a stepladder was used as a step: a) On or about May 17, 2011, Strathmore Homes, Inc., as the controlling employer, did not ensure that San Buena Construction, a sub-contractor, protected their employees from falls in excess of 10 feet while using a step ladder to access the roof and the trusses. The employees used the top of the ladder as a step.
