29 CFR 1926.651(k)(1):     Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems:     Employees working in an approximately 8 foot deep excavation were exposed to cave-in hazards and the employer did not initiate and maintain programs which provided for inspections at the start of the shift, and as needed throughout the shift, of the excavation, the adjacent areas, and protective systems to be made by a competent person.    ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH THE REQUIREMENTS OF 29 CFR 1903.19(c).

The employer had not complied with the provisions of 29 CFR 1926.652(b)(1)(i) in that the excavation was sloped at an angle steeper than one and one-half horizontal to one vertical (34 degrees measured from the horizontal):            An employee working in an approximately 8 foot deep excavation was exposed to cave-in hazards and the exposed employee was not protected by an adequate protective system.    ABATEMENT DOCUMENTATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH THE REQUIREMENTS OF 29 CFR 1903.19(d).

29 CFR 1926.1053(b)(1):     Where (a) portable ladder(s) was/were used for access to an upper level landing surface and the ladder's length did not allow the ladder side rails to extend at least 3 feet (0.9 m) above the upper landing surface being accessed, the ladder(s) was/were not secured at its top to a rigid support, and/or a grasping device, such as a grabrail, was not provided to assist the employees in mounting and dismounting the ladder:    Employees were exposed to falls of approximately 8 feet while using a portable ladder which extended only to the top of the 8 foot excavation, and not at least 3 feet above the edge of the excavation.    ABATEMENT CERTIFICATION IS REQUIRED FOR THIS ITEM IN ACCORDANCE WITH THE REQUIREMENTS OF 29 CFR 1903.19(c).
