Section (5)(a)(1): The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to potential crushing hazards from falling loads and/or lift parts: (a) For the employees who work around and under the various Ben Pearson and Challenger 4-post lifts that were not being lowered onto the safety locks when elevated to perform work in the shop area of TMA Tire, MUffler, & Alignment, located at 1811 West Main Street, Rapid City, South Dakota. (b) For the employees who work around and under the various Ben Pearson 2-post lifts with hydraulic leaks and missing telescoping stop in the shop area of TMA Tire, Muffler, & Alignment, located at 1811 West Main Street, Rapid City, South Dakota. (c) For the employees who work around the Ben Pearson tire lift with the lock mechanism missing in the tire shop of TMA Tire, MUffler, & Alignment, located at 1811 West Main Street, Rapid City, South Dakota.
