OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to crushing injuries during lifting operations involving the use of the Tecnomagnete Maxx 250 manually controlled permanent magnet lifter (Serial # SM. 0224).      a) On or about May 12, 2011, operators of the Tecnomagnete Maxx 250 magnet lifter were not informed of safe practices and operating procedures suggested by the manufacturer of the lifting device such as, but not limited to, how load characteristics will affect the lifting capacity, inspection of the device, and condition of the load thickness required for operations.    b) On or about May 12, 2011, the employer did not ensure that the below-the-hook lifting device handled loads for which it was designed.  Employees were exposed to crush-by injuries in that the steel pulley being lifted by the Tecnomagnete Maxx 250 magnet lifter in that the pulley exceeded the magnet's maximum size capacity for this material due to the shape and configuration of the part.    Abatement Note: Among other methods, one feasible and acceptable abatement method to correct this hazard is to comply with American Society of Mechanical Engineers (ASME) B30.20-2010 "Below-the-Hook Lifting Devices Safety Standard for Cableways, Cranes, Derricks, Hoists, Hooks, Jacks, and Slings."
