29 CFR 1926.501(b)(13):  Each employee engaged in residential construction activities 6 feet(1.8 m) or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems:         a)  Tovar-Moreno, Rafael at 1292 Mathew's Way, Erie, CO 80516:  On or before 6/25/11, the employer did not ensure that employees were using fall protection in the following instances:         1)  One employee was sheathing a roof with a 6 in 12 pitch on a new two story residence without the use of fall protection; and         2)  Two employees were working on the second floor, and three window openings were not properly guarded.  Each window was 4 feet long, and the bottom ledge was 36 inches above the floor.    Conditions exposed employees to fall hazards of up to approximately 20 feet.    Abatement note:  Abatement certification is required for this item (See enclosed "Sample Abatement-Certification Letter    Abatement note:  1926.502(b) provides that the top edge of the guardrail system shall be 42 inches +/- 3 inches.
