29 CFR 1910.23(c)(1): Open-sided floors and/or platforms four feet or more above adjacent floor or ground level were not guarded with standard railings (or equivalent) and toeboards (Note: Toeboards are required when persons or moving equipment pass beneath): a) On or about June 25, 2011, and at times prior, Colorado Motorsport Pdoduction, as creating and correcting employer, did not ensure that employees of MX Sprots were protected from fall hazards while standing on top of a 12 foot unguarded tunnel at the timing loop location with the Toyota Tundra banner between flagger spots 23 and 24 to watch the race participants at the Thunder Valley National Motocross Race at 701 S. Rooney Road in Lakewood, Colorado.
