29 CFR 1926.21(b)(2): The employer did not instruct each employee in the recognition and avoidance of unsafe condition(s) and the regulation(s) applicable to the work environment to control or eliminate any hazard(s) or other exposure to illness or injury: a) An employee was in an unprotected excavation on the west side of lange avenue in front of a residential house connecting a concrete inlet, operating a portable cutoff saw to remove an existing ductile iron pipe, using a shovel to dig around existing utilities and prepare the sub grade at a depth of approximately 5.5 feet deep. The employee had not received instruction from the employer to recognize and avoid the unsafe condition and the regulation(s) applicable to the work environment to control or eliminate any hazard(s) or other exposure to illness or injury. b) An employee was in an unprotected excavation on the west side of lange avenue towards church street connecting a concrete inlet, installing polyethylene tape, and preparing the sub grade at a depth up to approximately 6.2 feet deep. The employee had not received instruction from the employer to recognize and avoid the unsafe condition and the regulation(s) applicable to the work environment to control or eliminate any hazard(s) or other exposure to illness or injury.

29 CFR 1926.651(k)(1): Daily inspections of excavations, the adjacent areas, and protective systems were not made by a competent person for evidence of a situation that could have resulted in possible cave-ins, indications of failure of protective systems, hazardous atmospheres, or other hazardous conditions: a) An employee was in an unprotected excavation on the west side of lange avenue in front of a residential house connecting a concrete inlet, operating a portable cutoff saw to remove an existing ductile iron pipe, using a shovel to dig around existing utilities and prepare the sub grade at a depth of approximately 5.5 feet deep. The excavation was not inspected by a competent person before the employee was allowed to enter the excavation. b) An employee was in an unprotected excavation on the west side of lange avenue towards church street connecting a concrete inlet, installing polyethylene tape, and preparing the sub grade at a depth up to approximately 6.2 feet deep.
