29 CFR 1926.652(a)(1): Each employee in an excavation was not protected from cave-ins by an adequate protective system designed in accordance with 29 CFR 1926.652(b) or (c):\\r\\n(a) Community Preservation & Management, LLC at 6860 Zenobia Cir, Westminster, CO 80030: On and before June 27, 2011 the exposing employer did not ensure that each employee working inside a trench applying waterproofing material to a concrete wall was protected from cave-in. The employer did not comply with the provisions of 29 CFR 1926.652(c)(1), in that the design for the timber shoring used in the trench did not meet the requirements set forth in Appendix C of this subpart. This condition exposed employees to a crushing hazard by excavation wall cave-in.

29 CFR 1910.134(d)(1)(iii): The employer did not identify and evaluate the respiratory hazard in the workplace:\r\n(a) Community Preservation & Management, LLC at 6860 Zenobia Cir, Westminster, CO 80030: On and before June 27, 2011 the exposing employer did not identify and evaluate the respiratory hazard in the workplace, in that employees were potentially exposed to inhalation of petroleum asphalt, stoddard solvent, and 1, 2, 4-trimethylbenzene while applying Henry Company HE101 Un-Fibered Foundation Coating. Employees worked inside a trench that was approximately 7 feet in depth while applying the coating.
