As of 06/29/2011, the employer failed to document or certify that refresher training was provided to fork-truck operators every third year, as required.

29 CFR 1910.178(p)(1): Powered industrial truck(s) with defect(s) or in any way unsafe had not been withdrawn from service until restored to safe operating condition(s):         The employer failed to ensure that the company's Toyota: lift truck model no. FD 150, serial no. FD 150-10139 was removed from service until restored to safe operations condition. Defects of the lift truck include, but are not limited to,   was removed from service until restored to safe operations. Defects of the lift truck include, but are not limited to, the fork attachment used with the equipment was bent and were not rated to lift the materials being hoisted. In addition the vehicles horn was discovered to be in operable, as well.
