29 CFR 1926.1101(k)(2)(i): Before work subject to this standard began, the building and/or facility owner(s) did not determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the worksite pursuant to 29 CFR 1926.1101(k)(1):\r\n(a) First and Broadway Venture LLC at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, the building and/or facility owner did not, before work subject to this standard began, determine the presence, location and quantity of asbestos containing material (ACM) and/or presumed asbestos containing material (PACM) at the work site pursuant to paragraph (k)(1) of this section. Contractors performed demolition work on the main floor and mezzanine levels of the facility. Presence, location, and quantity of ACM and PACM building materials such as, but not limited to, pipe insulation, textured drywalls and ceilings, and surfacing materials were not determined prior to the start of work. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).

29 CFR 1926.1101(k)(2)(ii): The building and/or facility owner(s) did not notify prospective employers, tenants, employees of the owner, and all employers of employees who would be performing work within adjacent areas of the presence, location, and quantity of asbestos containing material or presumed asbestos containing material, at the work sites in their buildings and facilities in writing or a personal communication: (a) First and Broadway Venture LLC at 65 North Broadway, Denver, CO 80203: On and before May 13, 2011, the building and/or facility owner did not inform all employers of employees who worked within or adjacent to the areas containing ACM and PACM of the presence, location, and quantity of these materials. This condition exposed employees to an asbestos hazard. Abatement Note: Abatement certification and documentation are required for this item (see enclosed Certification of Corrective Action Worksheet).
