29 CFR 1926.701(b): Reinforcing steel. All protruding reinforcing steel, onto and into which employees could fall, was not guarded to eliminate the hazard of impalement. (a) Irish Construction Company on or about July 1, 2011 at the Detroit Ave. Storm Basin, Toledo, OH: The employer failed to ensure the reinforced steel protruding approximately 18 inches above the walking/working surface was adequately guarded to prevent employee impalement. Exposed employees were crossing the unprotected steel and directly adjacent while pouring concrete.

29 CFR 1926.501(b)(1) Each employee on a walking/working surface (horizontal and vertical surface) with an unprotected side or edge which is 6 feet (1.8 m) or more above a lower level was not protected from falling by the use of guardrail systems, safety net systems, or personal fall arrest systems. a) Irish Construction Company on or about July 1, 2011 at the Detroit Ave. Storm Basin, Toledo, OH: The employer did not ensure employees were protected from falling approximately 16.00 feet to the lowest level. The exposed employees were pouring a concrete wall and were exposed to fall hazards while accessing the working surface.
