Section 5(a)(1) of the Occupational Safety and Health Act of 1970: The employer did not furnish employment and a place of employment which was free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in that employees were exposed to struck by hazards.    a)  On or about June 30, 2011 and at times prior, Pense Brothers Drilling did not ensure that employees were proteced from struck by hazards.  The pin used to connect the stiff arm to the tongs was improperly installed.  The pin used had no flange or shoulder to maintain proper placement.  The pin used was held in place by a piece of welding rod instead of a rated keeper.    Among other methods, one feasible and acceptable method to correct this hazard is to ensure that proper replacement pins and keepers be supplied and the crew trained in proper usage and assembly.

29 CFR 1910.184(c)(1): Sling(s) that were damaged or defective were used:      a)  On or about June 30, 2011 and at times prior Pense Brothers Drilling did not ensure that employees were protected from struck by and caught between hazards.  Synthetic slings used to move heavy pieces of machinery, in the set-up and operation of the drilling rig were damaged.    Abatement Note:  Abatement certification and documentation are required for this item (see enclosed "Certification of Corrective Action Worksheet").

29 CFR 1910.184(d):     Sling(s) and fastenings were not inspected each day or during use and were not removed from service when damaged or defective:      a)  On or about June 30, 2011 and at times prior, Pense Brothers Drilling did not ensure that employees were protected from struck by or caught between hazards.  Synthetic slings used to lift heavy pipe, machinery, and tools were not inspected daily nor were they taken out of service when found to be damaged and defective.
