29 CFR 1910.178(p)(1):  If at any time a powered industrial truck is found to be in need of repair, defective, or in any way unsafe, the truck shall be taken out of service until it has been restored to safe operating condition.           The employer failed to ensure that the company's Nissan 50: (LP) fork lift, model # KCPH08A25 (forklifts) was removed from service until restored to safe operations. Defects of the fork truck include, but are not limited to; the fork(s) of the fork truck were attached by a piece of wire instead of a lug nut or screw.

1910.212(a) (1): Machine guarding was not provided to protect the operator and other employees in the machine area from hazards such as those created by point of operation, ingoing nip points, rotating parts, flying chips and sparks.           As of 06/27/2011, the following equipment, located int the warehouse/production area was not properly guarded:    a.       Milacron: robotic arm which exposed operators to point of operation and caught by or struck by hazards.    b.      Dixon: press which was missing the ring guards thus, exposing operators to unintended operation of the            press and points of operation hazards.
