29 CFR 1904.39(a): The employer did not orally report the death of an employee or the in-patient hospitalization of three or more employees because of a work-related incident. (a) Basic American Foods Plant, Rexburg, ID., on or about 07/13/2011, the employer failed to report to OSHA a fatality that occurred in the workplace within 8 hours of the incident. Plant management became aware of the incident at about 12:35 a.m. but it wasn't reported until 3:00 p.m. or over 14 hours later at approximately 3:00 p.m. Note: Abatement certification is NOT required for this item.
