OSH ACT of 1970 Section (5)(a)(1):  The employer did not furnish employment and a place of employment which were free from recognized hazards that were causing or likely to cause death or serious physical harm to employees in which employees were exposed to death or multiple injuries from a fall from elevation hazard created by the improper use of a self propelled elevating work platform:    One employee who was using a scissor lift to access/egress a steel beam work surface was exposed to the hazard of falling from an elevation while climbing up, over, and off of the guardrail system of a MEC 33RT scissor lift work platform at a height greater than fourteen (14) feet above a compacted surface located at 1014 W Ryan Street in Brillion, Wisconsin.      Among other methods, feasible and acceptable abatement methods to correct this hazard are to ensure conformance to good safety practices for the use and operation of self-propelled elevating work platforms is used according to the acceptable requirements of the approved American National Standard for Self-Propelled Elevating Work Platforms ANSI/SIA A92.6-2006, Section 7, Responsibilities of Users, and other acceptable industry practices.  The ANSI consensus standard requires the following:    7.10 Operator warnings and instructions.  (9)  Personnel footing.  Personnel shall maintain a firm footing on the platform floor while working theron.  Climbing by occupants on the midrail or toprail of the aerial platform is prohibited.

29 CFR 1926.760(b)(3): Each connector was not provided, at heights over 15 and up to 30 feet above a lower level, with a personal fall arrest system, positioning device system or fall restraint system and wear the equipment necessary to be able to be tied off; or be provided with other means of protection from fall hazards in accordance with paragraph (a)(1) of this section:    An employee who was performing steel connector work was sitting with his legs straddling a steel beam at a height of twenty (20) feet above compacted surface without wearing fall protection equipment.
