29 CFR 1910.95(k)(1):The employer shall train each employee who is exposed to noise at or above an 8-hour time weighted average of 85 decibels in accordance with the requirements of this section. The employer shall institute a training program and ensure employee participation in the program.\r\n\r\nThe employer did not ensure that employees exposed to noise at or above 85 decibels participated in a training program which included:\r\n1) The effects of noise on hearing;\r\n2) The purpose of hearing protection, the advantages, disadvantages and attentuation of various types and instructions on selection, fitting, use and care;\r\n3) The purpose of audiometric testing and an explanation of the test procedures.\r\n\r\nEmployees working at the Washer Machine in the Clean Room were exposed to noise at 87.94 decibels.

29 CFR 1904.10(a): \r\n\r\nBasic requirement. If an employee\'s hearing test (audiogram) reveals that the employee has experienced a work-related Standard Threshold Shift (STS) in hearing in one or both ears, and the employee\'s total hearing level is 25 decibels (dB) or more above audiometric zero (averaged at 2000, 3000, and 4000 Hz) in the same ear(s) as the STS, you must record the case on the OSHA 300 Log.\r\n\r\nThe employer did not ensure that a standard threshold shift (STS) was recorded on the 2010 OSHA 300 Log in that on or about December 10, 2010 an employee received an audiogram which revealed an OSHA recordable standard threshold shift in the left ear and no retest was conducted.

29 CFR 1910.134(c)(2)(i): \r\n\r\nAn employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section (\"Information for Employees Using Respirators When Not Required Under the Standard\"); and    The employer did not give a copy of Appendix D of 1910.134 to employees that voluntarily wore dust masks.
