29 CFR 1926.95(a): Protective equipment, including personal protective equipment for eyes, was not used wherever it was necessary by reason of hazards encountered in a manner capable of causing injury or impairment in the function of any part of the body through physical contact: Findlay Roofing & Home Inprovement, Findlay, Ohio: On or about July 18, 2011, at address 1701 Bay Hill, Findlay, OH, the employer failed to ensure that each employee used appropriate eye protection while engaged in nailing activities, such as securing shingles to the structure roof with a pneumatic nailer, exposing employees to eye injuries from flying particles.

29 CFR 1926.501(b)(13): Each employee engaged in residential construction activities 6 feet or more above lower levels was not protected by guardrail systems, safety net systems, or personal fall arrest systems, nor did the employer demonstrate that it is infeasible or creates a greater hazard to use these systems and develop and implement a fall protection plan which meets the requirements of paragraph (k) of section 1926.502: Findlay Roofing & Home Improvement, Findlay, Ohio: On or about June 18, 2011, at address 1701 Bay Hill, Findlay, OH, the employer did not ensure that employees were protected from falls while applying new roofing to a sloped roof on a residential type structure. Employees were exposed to a potential 9.4 ft. fall to the lower level below.
