29 CFR 1910.1030(f)(1)(i):     The employer shall make available the hepatitis B vaccine and vaccination series to all employees who have occupational exposure, and post-exposure evaluation and  follow-up to all employees who have had an exposure incident.    (a)  Lifeguards who are designated to provide first aid and CPR were not offered the hepatitis B vaccination series to prevent hepatitis B from a potential exposure incident.

29 CFR 1910.1030(c)(1)(iv):     The Exposure Control Plan shall be reviewed and updated at least annually and whenever necessary to reflect new or modified tasks and procedures which affect occupational exposure and to reflect new or revised employee positions with occupational exposure. The review and update of such plans shall also:    (a)  The exposure control plan for employees designated as first aid/CPR providers has not been reviewed or updated since November 2006.

29 CFR 1910.1030(g)(2)(i):     The employer shall train each employee with occupational exposure in accordance with the requirements of this section. Such training must be provided at no cost to the employee and during working hours. The employer shall institute a training program and ensure employee participation in the program.    (a)  Lifeguards designated as first aid/CPR providers were not provided with information and training on the company's exposure control plan regarding implementation and requirements to prevent exposure incidents.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals intheir work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trainedabout is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability,carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety datasheets.    (a)  The employees working in the snack shop and pool area use chemicals such as sanitizer cleaner for cleaning counters, hand soap, pool shock and stabilizer with no training on the hazards of the chemicals, location of the material safety data sheets or implementation of the written hazard communication program.
