29 CFR 1910.1200(g)(1):     Chemical manufacturers and importers shall obtain or develop a material safety data sheet for eachhazardous chemical they produce or import. Employers shall have a material safety data sheet in the workplace for each hazardous chemical which they use:    a.  At the workplace, the employer did not have a material safety data sheet for each hazardous chemical/product used by employees.  Chemicals/products used by employees included but were not limited to the following:  granite, containing crystalline silica.

29 CFR 1910.1200(h)(1):     Employers shall provide employees with effective information and training on hazardous chemicals intheir work area at the time of their initial assignment, and whenever a new physical or health hazard the employees have not previously been trainedabout is introduced into their work area. Information and training may be designed to cover categories of hazards (e.g., flammability,carcinogenicity) or specific chemicals. Chemical-specific information must always be available through labels and material safety datasheets.    a.  At the workplace, information and training was not provided to employees using hazardous chemicals/products in the performance of their job assignments.  Hazardous chemicals/products used by employees included but was not limited to the following:  granite, containing crystalline silica.

29 CFR 1910.132(d)(2):     'The employer shall verify that the required workplace hazard assessment has been performed through a written certification that identifies the workplace evaluated; the person certifying that the evaluation has been performed; the date(s) of the hazard assessment; and, which identifies the document as a certification of hazard assessment.    a.  At the workplace, the employer did not certify in writing that a hazard assessment of the workplace had been performed.

29 CFR 1910.134(c)(2)(i):     An employer may provide respirators at the request of employees or permit employees to use their own respirators, if the employer determines that such respirator use will not in itself create a hazard. If the employer determines that any voluntary respirator use is permissible, the employer shall provide the respirator users with the information contained in Appendix D to this section ("Information for Employees Using Respirators When Not Required Under the Standard"):    a.  At the workplace, employees permitted to use their own respirators were provided with the information contained in Appendix D of the respirator standard.
